    Mr. McFarlane is widely recognized as a leading real estate attorney active at both the local and the national level. Mr. McFarlane routinely handles highly complex legal matters involving all aspects of commercial and residential real estate. He has served as lead attorney on a wide variety of real estate litigation matters, including complex title litigation, bankruptcy cases, contract disputes, foreclosure litigation, and consumer disputes.

    He also routinely provides transactional real estate advice, including the drafting and negotiation of mortgage renegotiation and loan restructuring documents, the creation of legal and financial vehicles required to close deals, and the negotiation and resolution of disputes and matters involving the secondary loan market. His clients range from individuals to corporate real estate developers to large national mortgage lenders. In addition to providing legal and consulting services to Fluet & Huber, Mr. McFarlane is the owner and manager of Highland Title & Escrow, which has overseen thousands of real estate transactions.

    Earlier in his career, Mr. McFarlane appeared before trial level and appellate courts arguing cases involving a broad array of issues involving criminal and civil law and procedure.

    • Negotiates and resolves complex lender dispute and related matters involving the secondary loan market.
    • Routinely represents clients in disputes involving all aspects of real estate sales, title defects, and other real estate related litigation and transactional matters.
    • Counsels clients regarding the enforcement of mortgage liens and the legality of foreclosure proceedings.
    • Advises parties regarding the settlement of real estate transactions in multiple jurisdictions.
    • Provides pro bono services to various corporate and individuals regarding a wide array of sensitive financial and real estate matters.
